WHAT ARE THE DUTIES OF THE ZONING OFFICIAL?

 It is the zoning official’s duties to enforce Chapter 30, Land Use Regulations of the Township Code. Section 30-5.9 outlines the powers and duties of the Zoning Officer as follows:

a. To inspect and examine structures and uses in the Township and any plans for structures and uses to determine their compliance with the provisions of the land use regulations.

b. To determine that a structure, use or premises is in violation of the provisions of any land use regulation and shall notify the owner in writing of the violation found and specify the remedy ordered and a time period to correct the violation.

c. To issue zoning permits in accordance with the requirements and subject to the provision of the code.

d. Maintain a permanent record of all matters considered and all action taken.

e. Prepare a monthly report to the Township Committee of all action taken, including permits, denials, complaints of violations received and found.

f. Review as-built drawing for all newly drilled wells and septic systems, all new foundations constructed showing their offset dimensions in relationship to all property lines, as-built surveys as required.

The Zoning Official also enforces Section 3-8, Inoperable or abandoned vehicles, and Section 3-10, Alarm Systems of the Township Code.

 

WHEN IS A ZONING PERMIT IS REQUIRED?

A zoning permit is required prior to the construction of new homes, additions, renovations, decks, sheds, swimming pools (above ground and in ground), accessory structures, fences, change of use, and any other structures or improvements which may be required in accordance with the municipal code. The property owner shall be asked to submit an Application for Zoning Permit to the Zoning Official so that she can review the project for compliance with the Zoning Ordinance. Application for Zoning Permit is available at the municipal office during regular business hours.

The Township of Green has multiple zoning districts, each with its own minimum lot area, front, side and rear yard setbacks, maximum height and maximum building coverage requirements. The Schedule of Zoning Requirements and the Zoning Map should be reviewed to determine what zone your property is located and which zoning requirements pertain to your project.

WHAT IF YOUR PROJECT DOES NOT COMPLY WITH THE ZONING ORDINANCE?

If the property owner can not comply with the Zoning Ordinance for any reason, a variance must be obtained from the Land Use Board before the project can proceed. The Zoning Official is charged with the responsibility of enforcing the Zoning Ordinance, and may not waive the requirements. That power is granted by law to the Land Use Board. If the project does require a variance, the Zoning Official or Land Use  Board Secretary, Kim Mantz will explain the application process to you.


WHAT ARE THE FEES TO APPLY FOR AN APPLICATION FOR ZONING PERMIT?

  • New Construction – Commercial                         $150.00
  • New Construction – Residential                          $100.00
  • Accessory Structure                                             $ 35.00
  • Alterations                                                            $ 25.00
  • Nonconforming Use Certificate                            $ 50.00
  • Resubmit of Denied Application                           $ 15.00
